1. Oggetto e accettazione 1. Purpose and Acceptance
I presenti Termini e Condizioni regolano l'utilizzo della piattaforma PPWRItalia (di seguito, la "Piattaforma") fornita da Absolute Srl. Accedendo o utilizzando la Piattaforma, l'azienda cliente e i suoi utenti autorizzati accettano integralmente questi termini. These Terms and Conditions govern the use of the PPWRItalia (the "Platform") provided by Absolute Srl. By accessing or using the Platform, the customer company and its authorized users fully accept these terms.
2. Licenza d'uso 2. License to Use
Concediamo all'azienda cliente una licenza d'uso non esclusiva, non trasferibile e revocabile sulla Piattaforma, limitata alla durata dell'abbonamento attivo e riservata agli utenti autorizzati dall'azienda stessa. Questa licenza non comporta alcun trasferimento di proprietà del software, del codice sorgente o della proprietà intellettuale ad esso relativa. We grant the customer company a non-exclusive, non-transferable, revocable license to use the Platform, limited to the duration of the active subscription and reserved to users authorized by that company. This license does not transfer any ownership of the software, its source code, or the intellectual property associated with it.
3. Abbonamenti e pacchetti 3. Subscriptions and Packages
L'accesso alla Piattaforma è regolato da pacchetti di abbonamento, ciascuno con propri limiti di utilizzo (ad esempio numero di richieste di conformità PPWR gestibili e spazio di archiviazione documenti). I dettagli del pacchetto sottoscritto sono indicati al momento dell'acquisto e consultabili nell'area account. Access to the Platform is governed by subscription packages, each with its own usage limits (for example the number of PPWR compliance records that can be managed and document storage space). The details of the subscribed package are provided at the time of purchase and available in the account area.
4. Fornitura "così com'è" (AS IS) 4. "As Is" Provision
LA PIATTAFORMA VIENE FORNITA "COSÌ COM'È" ("AS IS"), SENZA GARANZIE DI ALCUN TIPO, ESPLICITE O IMPLICITE, INCLUSE — A TITOLO ESEMPLIFICATIVO E NON ESAUSTIVO — GARANZIE DI COMMERCIABILITÀ, IDONEITÀ A UNO SCOPO PARTICOLARE, ASSENZA DI INTERRUZIONI, ERRORI O DIFETTI. NON GARANTIAMO CHE IL SERVIZIO SARÀ SEMPRE DISPONIBILE, ININTERROTTO O PRIVO DI ERRORI. THE PLATFORM IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING — WITHOUT LIMITATION — WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ABSENCE OF INTERRUPTIONS, ERRORS, OR DEFECTS. WE DO NOT WARRANT THAT THE SERVICE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, OR ERROR-FREE.

La Piattaforma è uno strumento di supporto alla gestione documentale e di processo per le attività connesse al Regolamento UE Imballaggi e Rifiuti da Imballaggio (PPWR). L'utilizzo della Piattaforma NON COSTITUISCE consulenza legale o normativa e NON GARANTISCE la conformità effettiva dell'azienda cliente al PPWR o ad altra normativa applicabile. La responsabilità di verificare e garantire la propria conformità normativa resta in capo esclusivamente all'azienda cliente. The Platform is a tool that supports document and process management for activities related to the EU Packaging and Packaging Waste Regulation (PPWR). Use of the Platform DOES NOT CONSTITUTE legal or regulatory advice and DOES NOT GUARANTEE the customer company's actual compliance with the PPWR or any other applicable regulation. The responsibility to verify and ensure its own regulatory compliance remains exclusively with the customer company.
6. Limitazione di responsabilità 6. Limitation of Liability
Nei limiti massimi consentiti dalla legge applicabile, Absolute Srl non sarà responsabile per danni indiretti, incidentali, consequenziali o per perdita di profitti derivanti dall'uso o dall'impossibilità di utilizzare la Piattaforma. La responsabilità complessiva, ove non diversamente escludibile per legge, è comunque limitata all'importo corrisposto dal cliente negli ultimi 12 mesi di abbonamento. To the maximum extent permitted by applicable law, Absolute Srl shall not be liable for indirect, incidental, consequential damages, or loss of profits arising from the use or inability to use the Platform. Overall liability, where it cannot otherwise be excluded by law, is in any case limited to the amount paid by the customer over the preceding 12 months of subscription.
7. Obblighi del cliente 7. Customer Obligations
L'azienda cliente si impegna a: fornire dati accurati e aggiornati; utilizzare la Piattaforma nel rispetto della legge; mantenere riservate le credenziali di accesso dei propri utenti e a notificarci tempestivamente eventuali usi non autorizzati. The customer company agrees to: provide accurate and up-to-date data; use the Platform in compliance with the law; keep its users' login credentials confidential and promptly notify us of any unauthorized use.
8. Sospensione e cessazione 8. Suspension and Termination
Ci riserviamo il diritto di sospendere o cessare l'accesso alla Piattaforma in caso di mancato pagamento o violazione dei presenti termini. Alla cessazione del rapporto, l'azienda cliente potrà richiedere l'esportazione dei propri dati entro un termine ragionevole, salvo quanto diversamente concordato. We reserve the right to suspend or terminate access to the Platform in the event of non-payment or breach of these terms. Upon termination of the relationship, the customer company may request the export of its data within a reasonable timeframe, unless otherwise agreed.
9. Legge applicabile e foro competente 9. Governing Law and Jurisdiction
I presenti termini sono regolati dalla legge italiana. Per qualsiasi controversia sarà competente in via esclusiva il Foro di Firenze. These terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the Court of Florence, Italy.
